Why are you seeing this warning on certain VitaCup Products?
Some of VitaCup's products contain “heavy metals” naturally occurring in the soil where the natural foods we incorporate in our products are grown. The State of California requires companies like ours to feature the Proposition 65 warning label for food products containing naturally occurring lead content.
What is Prop 65?
The Safe Drinking Water and Toxic Enforcement Act of 1986 known as Prop 65 is a California law that requires the state to publish a list of chemicals known to cause cancer or birth defects or reproductive harm. Since 1986 the list has grown to include over 900 chemicals. The state of California designates a maximum allowable dose level of each chemical per day referred to as a safe harbor limit. These limits are then calculated with a threshold of 1,000 times below an observable effect limit. The observable effect limit is often calculated with animal studies. These limits set by California are much more stringent than nationally and internationally recognized limits presented by FDA, EPA, WHO and EU. A person eating the USDA recommended 3-5 servings of vegetables daily could consume up to ten times more lead than the stringent maximum limits set by California.

Are VitaCup Products Safe?
Yes. Food safety is our #1 priority. We follow the strict guidelines set forth by the Federal Drug Administration (FDA). We employ good manufacturing practices and source from farmers who use good agricultural practices to ensure that any trace levels of heavy metals in our products are naturally occurring and solely due to absorption from the soil where the foods we use in our products are grown.
Do other similar products contain similar levels of heavy metals deemed to be naturally occurring?
Many common foods contain even more naturally occurring heavy metal content when compared to Vitacup’s products. The average levels of lead found in the below food listing are well above the conservative limits established by California.
Why do other products that look like they contain the same ingredients not have a warning?
A lack of a warning on a product does not necessarily mean that the product is free from heavy metals, or that it falls below a specific limit. VitaCup takes significant measures to adhere to all laws and regulations applicable to its products.
